The process can be a long one. The court must first holding hearings to determine whether or not the person is deemed incapacitated.  If so, then the court must rule on the necessity of a legal guardian.  Finally, if all of the above are proved true, then a legal guardian, usually an immediate family member, close relative, or friend of the family is appointed by the court to act as the guardian.  Qualification includes being at least 18 years old, competent, and with no criminal records.

A legal guardianship may last forever, but it can be modified if the legal guardian is unfit or no long wish to be the guardian.  The guardianship can also be terminated if the incapacitated person once again become competent to make informed decision on their own.
